2. PURPOSE OF THIS MANUAL


This manual is compiled in accordance with Section 51 of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) ("PAIA") and serves as a guide for requesters of information held by Zukisa Capital (Pty) Ltd with registration number 2014/118559/07 ("the company") together with all its subsidiaries.

The purpose of this manual is to:

2.2 Give effect to the constitutional right of access to information;

2.3 Provide guidance on the procedures to be followed when requesting access to records;

2.4 Describe the categories and subjects of information held;

2.5 Outline the applicable fees for accessing information;

2.5 Describe how personal information is processed in accordance with POPIA.

4. THE GUIDE ON HOW TO USE PAIA


The South African Human Rights Commission ("SAHRC") has compiled a Guide on how to use PAIA in terms of Section 10 of the Act. The Guide provides information for any person wishing to exercise any right contemplated in PAIA and POPIA.

The Guide is available:

- On the SAHRC website: www.sahrc.org.za;

On the Information Regulator website: www.justice.gov.za/inforeg;

At the SAHRC offices during ordinary business hours;

Upon request to the SAHRC.


5. RECORDS AUTOMATICALLY AVAILABLE


The following categories of records held by the Website are made available to the public without the need to submit a formal PAIA request:

9. PROCEDURE FOR REQUESTING ACCESS


9.1 Request Form

A request for access to a record must be made on the prescribed Form 02 as published in the Regulations regarding the Promotion of Access to Information (GN R757 in Government Gazette 45057 of 27 August 2021).

10. DECISION ON THE REQUEST


10.1 Timeframe

Section 56 of PAIA requires that the Information Officer, as soon as reasonably possible but in any event within 30 days of receipt of a properly completed request, either grant or refuse the request and notify the requester accordingly.

10.2 Extension

The 30-day period may be extended by a further 30 days in the circumstances contemplated in Section 57 of PAIA.

Access to a record may be refused on grounds including:

11. FEES


11.1 Request Fee

A request fee may be payable for requests for access to records. The prescribed fees are available from the Information Regulator.

A fee may be charged for the reproduction of records, including:

The requester may apply to the Information Officer for a waiver of fees, subject to the criteria set out in the PAIA Regulations.


12. REMEDIES AND APPEALS


If a requester is dissatisfied with the outcome of a request, the following remedies are available:

12.1 Internal Appeal

An internal appeal may be lodged with the Information Officer in terms of Section 74 of PAIA using the prescribed Form 03.

12.2 Complaint to Information Regulator

A complaint may be lodged with the Information Regulator in terms of Section 77A of PAIA using the prescribed Form 05.

12.3 Court Application

An application may be made to the High Court for review of the decision.

14. UPDATING OF THIS MANUAL


This manual will be reviewed and, where necessary, updated by the Information Officer at intervals not exceeding 12 months, or sooner if material changes occur in the affairs of the Website or in the legislative framework.
